These are the terms and conditions as well as policies being implemented by electrawarehouse.com. These terms and conditions apply to you as a user of the Product/Service ("Customer" or "you"). These terms and conditions will take effect on July 11, 2007. Please read these terms and conditions carefully.
Business Hours
Our online store is available 24 hours a day and 7 days a week. Our customers may visit and shop at our online store virtually anytime and anywhere. Sales operations, customer support, order processing, shipping and deliveries are available only during Business Hours which is from 9:00 AM to 5:00 PM (PST), Mondays through Fridays, excluding holidays. Our online store may be unavailable for maintenance purposes which may occur at times deem neccessary by our technical team and/or by our web hosting service provider.
Item Availability
Most items on our site are available and are ready to ship. electrawarehouse.com performs daily updates on all items. However some items may suddenly become out of stock due to in-store sales and for other reasons beyond our control. Some items may either be placed temporarily out-of-stock or they may not be available for shipment until a specific delivery or release date provided by the manufacturer. Such cases may require extra time for reordering, sizing or other adjustments. In such cases, our customers shall be informed by e-mail of items in their order affected by its unavailability. We try our best to stock up on all products listed in our inventory and to keep our site up to date. electrawarehouse.com always strive to ensure prompt delivery on all our orders. In fact, over 90% of all orders are shipped within one business day.

Some products have a set public Street Date and cannot be sold until that date. If you happen to buy an unreleased product you will be notified right away and reimbursed immediately if you so wish it.

In some cases, some products in our web site may have been recalled or discontinued already by the manufacturer. You will also be notified of such instances and your order shall be cancelled and your payment refunded.

We can also exchange the out of stock, unreleased product, recalled or discontinued product for another item of the same price. If you wish to have an item that does not cost the same as what you paid for, the difference will either be refunded or charged to you.

Customer Representative
During the customer’s shopping experience on our site if the customer happens to run into any problems or errors please do not hesitate to notify electrawarehouse.com. Send an email to sales@electrawarehouse.com for any sales related questions or issues and customerservice@electrawarehouse.com for support or any other questions.

Our customer representatives are available only to process and facilitate our customer's orders and assist in the online sales ordering and processing. They may assist in providing options for your products but are not recommendatory in nature. It is still the customer's responsibility to verify the brand, model, features and specifications of the items they are ordering. Customers have to consult their own product specialists, installation, technical experts and do their own research for the exact brand and model of their orders. electrawarehouse.com will not be responsible for wrong models, features and specifications expected in a particular model. Orders will be processed exactly in the way they were received by our customer representatives. electrawarehouse.com will not accept returns as a result of an order for a wrong model, feature and specification.
Order Processing
Generally, all orders require 1-5 business days of processing time prior to shipping.

For Pyle, Legacy, Lanzar, Pyramid and Blitz, please allow 1-10 business days of processing time prior to shipping.

NOTE: Processing duration is separate and does not include the actual shipping duration.

Most items ordered from 9am - 3pm (PST) of a regular business day and without any exceptions will normally be shipped at the end of the day. An email notification will be sent the next business day after shipping together with the designated shipping agent used for the delivery and tracking information so our customers may monitor the schedule and progress of deliveries.
Sales Tax
Under California's State Laws, electrawarehouse.com must charge an 8.25% sales tax on any orders within California. Any order placed outside of California is exempt from California's State Sales Tax. For clarity, the customer's selected Shipping Address will determine whether or not California's Sales Tax should apply.
Payment Options and Verification
electrawarehouse.com currently offers two (2) Online Payment options:
  • PayPal
    For U.S. and Canada sales, our customers may opt to pay through PayPal.
  • eProcessingNetwork
    For U.S. sales only, our customers may opt to pay through eProcessingNetwork, electrawarehouse.com's built-in Electronic Payment Gateway.
Both electronic payment systems are secured but each one offer distinct customer protection schemes.

Payment Security Requirements
As part of the security measures electrawarehouse.com is implementing to protect our customers from fraud, we generally require that either the billing and shipping addresses be registered with the customer's credit card or in the case of PayPal, the shipping address must be confirmed.

Declined Transactions
Because of the level of security that we are implementing on our web site, there is a need for accurate payment information and valid credentials. Discrepancies due to these inaccuracies or lack of information may lead to Declined Transactions. There may be times that these declined transactions would seem to have been deducted from the customer's credit card's balance. They will actually be placed in a pending status but will automatically return to your account. It is a standard with most banks that these declined transactions will be reflected back into their source accounts after three (3) banking days. For International Credit Cards, this may take longer.

Payment Verification
In order to guard you the customer against credit card fraud we may contact you for any of the following situations:
  1. If the billing and shipping addresses are different - We must verify that the alternate shipping address is authorized.

    Please contact your credit card issuer bank and list your ship to address as an alternate address in their memo field. Please inform us as soon as you added your shipping address and we will verify it with your credit card issuer bank.
  2. If your order is over the average order amount - We must verify that you are indeed the credit card holder. You will be asked to fax or email a proof of address and a copy of your credit card.
  3. Any situation where there is a suspicion for fraud - We may contact you to determine validity of transaction, payment and identity. In order to protect our customers and electrawarehouse.com's interests, we reserve the right to cancel and deny any transaction as deemed necessary by electrawarehouse.com's management.
Order Notifications and Confirmations
After you place your order, you may receive confirmation e-mails about your order. E-mail notifications may be sent due to the following:
  • Your order has been received.
    This e-mail confirms that we have received your order. It includes your order number, which you must have for easy identification and reference. Keep this e-mail for your records.
  • Advance sales notice.
    This e-mail informs you that the product you order is either out of stock or not readily available to the public yet.
  • Your order has shipped.
    This e-mail confirms that your order or part of your order has shipped. Will receive multiple emails if you have order more then one product from us and they were shipped separately. The arrival time of your package depends upon which shipping option you chose.
  • Important notice about your order.
    There are few reasons why you would receive this e-mail, including but not limited to: difficulty in processing your order, inability to ship to the address provided, duplicate order, cancellation of order. Should you receive a notice like this, please send an email to sales@electrawarehouse.com so the problem can be addressed immediately.
Order Status
Check the status of your latest orders by visiting the My Account page. This is the easiest and quickest way to get the latest information regarding your orders. You will be prompted to log in with your e-mail address and password (we will never ask you for your login information). An order summary page will be shown providing you with detailed information about your current order or past orders. After your order is shipped, your tracking number, if available, will be displayed in the order information. You can click on the tracking number to view the delivery status of your order (also note, that we will send you your tracking number via email so you can track and monitor its progress). A shipping company may not always have the ability to track an order. Package tracking and monitoring policies, procedures and capabilities may vary depending on the shipping agent of choice.
Shipping and Delivery
Delivery of ordered items can take anywhere from two (2) to eight (8) business days (within the US), depending on your location and the shipping option you chose during checkout. All orders begin the shipping process as soon as your order is processed and received by our dedicated sales team. Your item will be shipped once the item is found to be in stock, and your receiving address is verified.
Shipping Options and Costs
At checkout, you will be prompted to choose a shipping method for your order. You will then be given a quote on the shipping costs involved. At this point, the customer has the option to proceed or to abort the order should the quoted rates be unacceptable. Shipping costs are dependent on the weight of the items you ordered, the shipping method you have selected and the destination shipping address. Your total shipping charges will be computed automatically and shown to you during the checkout process prior to the completion of your order.

Below are delivery durations and descriptions of shipping options prescribed by our preferred shipping agents:
  • UPS Standard Ground Shipping, 2-6 days:
    Most items may be shipped (unless otherwise stated) to the major 48 States via UPS Standard Ground service. You can expect your order to arrive within 2-6 business days.
  • UPS Three Day Ground, 3 days:
    Most items may be shipped (unless otherwise stated) to the major 48 States via UPS Three Day Ground service. You can expect your order to arrive within 3 business days.
  • UPS Second Day Air, 2 days:
    Most items may be shipped (unless otherwise stated) to the major 48 States via UPS Second Day Air service. You can expect your order to arrive within 2 business days.
  • UPS Next Day Air, 1 day:
    Most items may be shipped (unless otherwise stated) to the major 48 States via UPS Next Day Air service. You can expect your order to arrive within 1 business day.
Shipping to P.O. Boxes in the U.S.
If the intended shipping address is a Post Office (P.O.) Box, USPS will be the preferred shipping agent for the customer's order.
  • USPS Priority Delivery, 5-10 days:
    Most of our products can be shipped via USPS Priority Service, but some restrictions do apply. You can expect delivery within 5-10 business days.

    The following items cannot and will not be shipped via USPS Priority mail at this time:
    • Items over 70 lbs.
    • Freight-only items and flammable items

Shipping to Military APO / FPO Addresses
If the intended shipping address is an APO / FPO, USPS will be the preferred shipping agent for the customer's order.
  • USPS Priority Delivery, 5-10 days:
    Most of our products can be shipped via USPS Priority Service, but some restrictions do apply. You can expect delivery within 5-10 business days.

    The following items cannot and will not be shipped via USPS Priority mail at this time:
    • Items over 70 lbs.
    • Freight-only items and flammable items

International Shipping
We can only accomodate International Shipping to countries supported by our shipping agents. Furthermore, we only accept International Sales Payments made through PayPal.

PayPal Shipping Address Verification
As part of the security measures we are taking to protect our customers, we also require that the shipping address be PayPal confirmed. As of now, PayPal is able to confirm addresses in the US, Canada and the United Kingdom only. Until such time that PayPal is able to confirm addresses in countries other that those listed above, electrawarehouse.com will not be able to sell and ship to other countries. To ensure that the shipping address can be confirmed, please follow the guidelines below before making any PayPal transaction:
  • Use a shipping address which is registered with your credit card company. You may call your credit card company to register an additional or alternate shipping address.
  • Add the credit card with the registered shipping address in your PayPal Account.
  • Verify with your PayPal account that the newly added credit card and address has a confirmed status.
  • Use the confirmed credit card and address in making payments to electrawarehouse.com.
PayPal is also offering to U.S. PayPal members an alternative way of verifying their addresses. Please refer to PayPal's website and check for Alternate Address Confirmation.

NOTE: Unconfirmed PayPal shipping addresses are subject to automatic cancellation and refund.

Taxes and Duties for International Sales
Import taxes and duties may vary from country to country. Customers are solely responsible for paying these taxes and duties as required by the laws of the land. Furthermore, additional fees for packaging may also be applied.
Tracking your Order
To view status and tracking information for orders or partial orders that have been shipped:
  1. Click the My Account link on any electrawarehouse.com web page.
  2. Click the View Your Orders link to see a list of your orders, displayed by order number and date.
  3. Click the order number to see order details.
The order details screen shows the status of your order. It displays all the items you bought and tells you which ones have been shipped.

If all or part of an order has been shipped, you'll see the order status change to shipped. If your shipment was sent via a trackable method, a tracking number will be displayed. Follow this link for additional tracking information about your order. Sometimes the tracking number is available before the carrier has actually picked up your package. In this case, you'll get an error message, such as "Unable to track shipment," when you visit the carrier's Web site. If this happens, try tracking your order again in a few hours.
Order Cancellations
You can only request for the cancellation of orders if it has not been shipped yet. Should you refuse to receive a package delivered to you, you will have to pay for the costs of the return shipping and any other fees as a result of your non-acceptance. electrawarehouse.com also reserves the right to cancel and reject orders as deemed necessary.
Warranty
All products sold by electrawarehouse.com are new, first quality (never seconds) brand name merchandise. We do offer factory reconditioned items, the condition of those items are marked as factory reconditioned or its condition is explicitly labeled and they all come with a limited ninety (90) day warranty. electrawarehouse.com will honor a full one (1) year limited warranty on all brand new items. All warranty claims must be made through electrawarehouse.com customer service.
Return/Exchange Policy
electrawarehouse.com does not have a return policy. All sales are final, but merchandise could be returned to electrawarehouse.com within the first thirty (30) days of purchase for exchange or for store credit. electrawarehouse.com’s shipping charges are non-refundable. Customer has to pay to return the item back to electrawarehouse.com’s Warehouses, there will be a 30% Restocking Fee on all returned items.

electrawarehouse.com will not accept a return if your unit falls under these circumstances:
  • If the Customer does not want or need the product.
  • Wrong product model.
  • Special Order items.
  • Used/Damaged or if Factory Seal is broken.
Merchandise Returns
No returns can or will be accepted without prior authorization from our Returns Department. To request a Return Merchandise Authorization (RMA) Number for any of our warranty covered products please call us at (866) 709-6575. In the first thirty (30) days, returns can only be made for replacement or merchandise credit. Shipping charges are non-refundable; unless product was damaged during our shipping process. All items must be shipped freight prepaid through UPS, double-boxed with the given Return Merchandise Authorization Number displayed in plain sight on the outside of the package. All of our warranty items will be returned (via UPS) freight prepaid. A copy of your electrawarehouse.com invoice MUST be included with all returns for credit and will be subject to a fee of 30%, minus shipping and handling. Merchandise must be in 'new' or 'like-new' condition to be accepted by our Returns Department. Returns will be credited at the sale price on the invoice (less if any fees apply). If no invoices or receipts are included with the returned package, electrawarehouse.com will issue a credit at the current selling price of the product or the price at the time of sale of the product, whichever is lower. All items must be returned complete, with every accessory, manual and given equipment that it came with. Any missing parts or damaged packaging will be deducted from the amount credited, unless proof is given otherwise that the damage happened during the shipping process. Items returned with missing accessories (i.e. remote controls, wire harnesses, etc.) are subject to a charge of $25 and up for the replacement of any missing accessories. Items returned damaged and or abused will not be accepted and will be shipped back at your cost.

Misuse, Abuse, Tampering and/or Installation Error
electrawarehouse.com defines abuse of product as, but not limited to, burnt voice coils (blackened, no continuity, melted adhesives, coil separated from the former, etc.) punctured or damaged surrounds, broken speaker terminals, bent, chipped or broken frames, ripped spiders or damaged back and face plates, bent, twisted, terminals and contacts, cracked, broken cases. Products submitted with any of the above conditions or any similar signs of misuse, abuse and tampering will be considered out of warranty by our Returns Department. electrawarehouse.com will not be held liable for loss of use, installation, removal and reinstallation charges associated with the defective or returned product. Products that have been improperly installed will no longer be carried under warranty, and no credit or exchange will be given or made. It is highly recommended that you get your equipment professionally installed to prevent such loss. All returns, exchanges and refunds are processed within thirty (30) days upon receiving the item. Please allow two (2) weeks from the time you return your item for your refund or exchange to be reflected back into your account. If you paid by credit card, please allow two (2) full billing cycles for the credit to appear on your card statement.
Return/Exchange Procedures
The steps outlined below are there to help you, should you find it necessary to return/exchange any item(s) covered by the Return/Exchange Policy above. Any product returned must be in a re-saleable condition and must include the original packaging and documentation.
  1. Contact electrawarehouse.com to obtain an RMA number
    Contact electrawarehouse.com's Sales Department by email or call us at (866) 709-6575 to obtain a Return Merchandise Authorization (RMA) number before returning the product. Call during Business Hours which are from 9:00 AM and 5:00 PM (PST), Monday to Friday except on holidays. Products returned without an RMA number will be refused.
  2. Pack the product securely
    Pack the Product(s) securely, wrapped or packaged and in an external carton. Make sure you include a copy of the Packing List with your return. Make sure you include your name address and a contact telephone number.
  3. Label the package clearly with the RMA number and electrawarehouse.com's address
    Clearly mark the outside of the package or carton with electrawarehouse.com's address, telephone number and RMA number, as shown below. Please do not put the RMA number on the 'product' itself.

  4. Send your package, Carriage and Insurance Paid
    The customer is responsible for all shipping charges for products returned under our Returns Procedure unless this has been specifically agreed and confirmed in advance. electrawarehouse.com will not accept responsibility for loss or damage of goods during return, please make sure that the insurance cover option is taken with the courier service provider.
  5. Returned Products will be Inspected
    Upon receipt, all products will be inspected and at our discretion, credit may be refused or a restocking fee may be assessed. Our Returns Department will advise you.
NOTE:
  1. Packages without an RMA number on the outside will be refused.
  2. Incomplete packages will not be accepted.
  3. We cannot be held responsible for packages returned to us and lost or damaged in transit. As you are responsible for returning the item(s) to us, we strongly recommend sending the package through a reliable courier service (including insurance cover) or where appropriate by door to door courier service (including insurance cover).

Pricing Errors
While we make every effort to correctly price all our products, errors occasionally may occur resulting in a higher or lower price stated on the website. electrawarehouse.com reserves the right to cancel any order which includes a pricing error.
3rd Party Service Providers
To enhance our customer's experience, we employ several 3rd party service providers. These services may include, but are not limited to Security, Payment, Marketing and Advertising, Installation Assistance services and other services electrawarehouse.com may deem necessary and appropriate.

Discrepancies with 3rd Party Service Providers
Some of the information being utilized by our selected Service Providers come from our web site. These information may be synchronized at regular periods of time determined by each service provider. Since each party may be using disparate systems, there is always a possibility of having unsynchronized information. Should this occur, electrawarehouse.com's website will always be the final basis of all sales resulting from the service rendered by the provider.

We're aware of the trust and confidence you demonstrate when you visit our website and provide us with information. The Privacy Notice below is posted to demonstrate our adherence to the practices you'll find common to the best websites online. We promise that we will treat your information with the same honesty and sensitivity that we have displayed throughout our company's history.

Personal Information Collected By Electra Warehouse:
Electra Warehouse uses information that we collect from our visitors to personalize and improve your visit at electrawarehouse.com. We gather the following types of information:

  • Action Tags: Electra Warehouse's web pages may contain action tags set by third party firms for the purpose of collecting anonymous information about the usage of our site by customers. Action tags are also known as web beacons or 1 pixel gifs. Action tags are a technique used to compile aggregated statistics about the effectiveness of our web site. Sharing of Information with third-parties:

  • Orders and Catalog Requests: When you place your order and/or when you request that we send you a catalog from time to time we may share your name, mailing address and purchase category information with a few carefully selected marketing partners who may bring you offers of interest. We will never share any telephone number(s), or financial information which you have given us with any marketing partner(s).
  • Aggregate information: We provide aggregate information to some of our business partners. This information does not allow them to identify you individually.
  • Vendors: We provide some of our vendors with your contact information so that they may contact you directly with product support information.
  • Credit card companies and shippers: When you buy something from us we send your credit card information, name, billing address and the amount of your purchase to your credit card company to verify and authorize the purchase. Your name, telephone number and shipping information must be provided to third party shippers such as UPS, Federal Express and the United States Postal Service to deliver your purchase.
  • Third Party Transaction-Level Data: If you visit our site from a third-party site the third-party site may be able to access your individual transaction information. In order to track and credit your transaction the third-party site may give you a unique code, cookie or graphic which will uniquely identify you. This will only happen if you link directly from a third party site to our Web site. Any transactions made at our Web site while such a code is active will be reported back to the third party site. We will only report non-personal information to these sites such as the date of the transaction, the product(s) purchased and the amount spent. We will not report any information to these third party sites that will allow them to personally identify you, however based on information which may have previously been collected from you by the third party site they may be able to personally identify you by combining the information they have gathered with the information sent by us. Although we will attempt to only work with third parties who respect your privacy we are not responsible or liable for any information collected by these third parties or how it is used. Law Enforcement and Protection of Users:
We will release personally identifiable information to third parties and organizations when we believe it is appropriate for us to do so to comply with the law. We will also do so to cooperate with law enforcement investigations, comply with court orders or subpoenas, protect the legal rights of us and our users, or when we believe it is needed for fraud protection and/or credit risk reduction.

Business Transfer:
Electra Warehouse has been in business independently for years, and our intent is to continue for many more years to come. However, in the unlikely event that Electra Warehouse is sold, has substantially all of its assets acquired or merges or becomes affiliated with any other individual or entity, any customer information owned or under the control of electrawarehouse.com may be one of the transferred assets.

Security:
Our Web site protects the security of personal information you transmit to us by using Secure Sockets Layer (SSL) software, which encrypts the information you input during the transmission to us. We do not reveal your credit card number when we confirm your order. In order to protect against unauthorized access to your account you should sign off when you finish visiting our site.

Choice/Opt-Out:
Our Web site gives you the opportunity to opt-out of receiving communications from us. If you no longer wish to receive communications from us you may opt-out by calling (866) 709-6575 or e-mail customerservice@electrawarehouse.com.

Children's Online Policy:
Electra Warehouse is committed to the preservation of online privacy for all of its web site visitors, including children. Consistent with the Children's Online Privacy Protection Act, we will not knowingly collect any personally identifiable information from children under the age of 13. electrawarehouse.com sells products intended for purchase by adults. If you make a purchase on electrawarehouse.com, you are representing that you are an adult. If you are a child under the age of 13, you must ask your parent or guardian to assist you in using electrawarehouse.com.
